Senza voler trascurare le rilevanti problematiche inerenti il diritto di autore, come parte integrante della persona e del diritto di espressione, e pertanto la doverosa tutela dello stesso nell’era di internet, non possiamo esimerci dal constatare il fatto che, proprio in relazione a tali valori, non può essere accettato né il principio, né il modus operandi della detta delibera che, lungi dal tutelare veramente il diritto di autore, mina seriamente, dal punto di vista sostanziale e dal punto di vista formale, i diritti inviolabili dell’individuo.
